SweetPix Photo Tiles (“SweetPix,” “we,” “us,” or “our”) is operated by EMSLO, Inc. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit sweetpixtiles.com, create an account, upload photographs, place an order, contact us, or otherwise use our website and related services (collectively, the “Services”).

By using the Services, you acknowledge the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Services.

1. Personal Information We Collect

The personal information we collect depends on how you interact with SweetPix.

Information You Provide to Us

We may collect:

  • Contact and account information, such as your name, email address, telephone number, username, password, and account preferences.
  • Order and transaction information, such as the products you order, billing and shipping addresses, order history, delivery information, and information relating to returns, replacements, discounts, or customer service requests.
  • Payment information. Payments are processed by our payment service providers. SweetPix may receive limited payment-related information, such as the payment method, transaction status, billing name, and the last four digits of a payment card, but we do not intend to store complete payment-card numbers or card security codes.
  • Uploaded content, including photographs, images, cropping choices, layouts, captions, and other content you submit to create or order products.
  • Communications, including messages, emails, chat conversations, reviews, survey responses, and other information you provide when you contact us or communicate with us.
  • Marketing preferences, such as whether you wish to receive promotional emails or other marketing communications.
  • Business customer information, such as company name, job title, business contact details, and information relating to a business account or business order.

Information Collected Automatically

When you use the Services, we and our service providers may automatically collect:

  • IP address;
  • browser type, device type, operating system, and device identifiers;
  • general location derived from an IP address;
  • referring and exit pages;
  • pages, products, and features viewed;
  • links or buttons clicked;
  • dates, times, and duration of visits;
  • shopping-cart activity and purchase interactions;
  • cookie identifiers and similar information; and
  • information about the performance, security, and use of the Services.

We may collect this information through cookies, pixels, tags, software development tools, server logs, and similar technologies. The Meta Pixel may also collect information about actions taken on the Services, such as page views, products viewed, shopping-cart activity, checkout activity, and completed purchases, together with associated browser, device, cookie, and IP-address information.

Information From Other Sources

We may receive information from payment processors, shipping carriers, fraud-prevention providers, analytics providers, advertising and social media partners, customer-service providers, social media platforms when you interact with our pages or advertisements, and other service providers. We may combine this information with information collected through the Services.

2. How We Use Personal Information

We may use personal information to:

  • provide, operate, maintain, and improve the Services;
  • create and manage customer accounts;
  • receive, prepare, print, fulfill, ship, and support orders;
  • process payments and provide order confirmations, invoices, shipping updates, and other transaction-related communications;
  • display previews and allow customers to crop, arrange, or edit uploaded images;
  • respond to questions, customer-service requests, returns, replacements, and complaints;
  • maintain order records and, where available, make previous orders or uploaded content accessible through an account;
  • personalize content, product recommendations, and the customer experience;
  • detect, investigate, and prevent fraud, abuse, security incidents, and other unlawful or unauthorized activity;
  • debug, analyze, and improve the performance and usability of the Services;
  • send marketing communications, offers, and promotions, subject to your communication choices;
  • measure the effectiveness of advertising and marketing campaigns;
  • protect our customers, employees, business, property, and legal rights;
  • comply with applicable laws, regulations, legal processes, and tax or accounting obligations; and
  • carry out other purposes disclosed to you when information is collected or with your consent.

3. How We Handle Uploaded Photos

You retain ownership of the photos and other content you upload, subject to the limited rights described in our Terms of Use.

We use uploaded photos to provide the Services, including generating previews, processing and printing orders, providing customer support, addressing quality concerns, and keeping uploaded photos available through your account for future reorders. Access to uploaded photos is limited to SweetPix personnel and service providers who need access for these purposes.

Photos may contain personal information about you or other people, including children. Before uploading a photo, you are responsible for ensuring that you have the right and any necessary permission to provide it to us and use it in connection with your order.

We do not sell uploaded photos. We do not use uploaded photos to identify individuals through facial-recognition technology, and we do not use customer photos to train public artificial-intelligence models.

Uploaded photos are retained so they remain available through your account for future reorders, in addition to allowing us to fulfill orders and provide customer support. We retain them until you delete them or request deletion, or until we determine they are no longer reasonably necessary to provide the Services, subject to our legal, security, fraud-prevention, backup, and operational requirements. You may request deletion as described in Section 10. Deleting a photo or account may not remove copies contained in completed products, transaction records, routine backups, fraud-prevention records, or other records we are legally permitted or required to retain.

4. Cookies and Similar Technologies

We and our service providers use cookies and similar technologies for the following purposes:

  • Essential purposes, such as maintaining sessions, operating the shopping cart, remembering account settings, processing checkout, preventing fraud, and keeping the Services secure.
  • Functional purposes, such as remembering preferences and improving site features.
  • Analytics purposes. We use Google Analytics 4 (“GA4”), which uses cookies and similar technologies to collect information about visits, user interactions, traffic sources, devices, and site performance. We use this information to understand how visitors use the Services and to improve the website and customer experience. Google may process this information on our behalf in accordance with its own privacy practices.
  • Advertising purposes. We use the Meta Pixel, provided by Meta Platforms, Inc. (“Meta”), to measure advertising performance, understand whether visitors take actions after seeing or clicking an advertisement, create or refine advertising audiences, and show advertisements that may be more relevant to users of Facebook, Instagram, and other Meta services. The Meta Pixel uses cookies and similar technologies and may allow Meta to associate activity on the Services with information Meta maintains about its users. Meta processes information it receives in accordance with its own privacy policies.

The website does not currently offer a separate cookie-preference tool.

You can control or delete cookies through your browser settings. Blocking some cookies may prevent portions of the Services from working correctly. You may also use the Google Analytics Opt-out Browser Add-on to prevent GA4 from using your activity on the Services and adjust your advertising preferences through Meta’s Privacy Center. To request that SweetPix opt you out of the disclosure of personal information for cross-context behavioral or targeted advertising, email support@sweetpixapp.com with the subject line “Opt-Out Request.”

Some browsers offer a “Do Not Track” setting. Because there is not a universally accepted standard for responding to Do Not Track signals, the Services may not respond to those signals. Where required by applicable law, we process recognized universal opt-out signals, such as Global Privacy Control, as a request to opt out of the sale or sharing of personal information for the browser or device sending the signal.

5. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

  • Service providers and contractors that help us operate the Services, including website hosting, cloud storage, image processing, printing and production support, payment processing, fraud prevention, order management, shipping, email or text-message delivery, analytics, advertising, customer support, and information-security providers.
  • Payment processors and financial institutions to process transactions, refunds, chargebacks, and fraud checks.
  • Shipping and fulfillment providers to produce, fulfill, track, and deliver orders.
  • Analytics providers, including Google Analytics, that help us understand use of the Services and improve site performance.
  • Advertising and social media partners, including Meta, that help us measure advertisements, understand customer interactions, create advertising audiences, and provide more relevant advertising.
  • Professional advisers, such as attorneys, accountants, auditors, insurers, and consultants.
  • Government authorities and other parties when we reasonably believe disclosure is necessary to comply with law or legal process; investigate or prevent fraud, security issues, or unlawful conduct; enforce our agreements; or protect the rights, safety, and property of SweetPix, our customers, or others.
  • Parties to a business transaction, such as an actual or prospective purchaser, lender, investor, successor, or other party involved in a merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or similar transaction.
  • Other parties at your direction or with your consent.

Service providers and contractors are permitted to use personal information only as necessary to provide services to us or as otherwise allowed by law and contract.

6. Sale and Sharing of Personal Information

We do not sell personal information for money.

We use the Meta Pixel as described in Section 4. Disclosing identifiers and internet or electronic activity to Meta for advertising may be considered “sharing,” a “sale,” or use for targeted advertising under certain state privacy laws, even though no money is exchanged. Where applicable, you may opt out by emailing support@sweetpixapp.com with the subject line “Opt-Out Request” or by using a recognized universal opt-out signal. We do not knowingly sell or share the personal information of anyone under 16 years of age.

We do not use or disclose sensitive personal information for purposes that require a right to limit under California law.

7. Marketing Communications

You may unsubscribe from promotional emails by using the unsubscribe link included in the message or by contacting us. Even if you opt out of promotional messages, we may continue to send non-promotional communications about your account, orders, transactions, customer-service requests, security, or changes to our policies.

If SweetPix offers text-message marketing, you may opt out by replying STOP to a marketing text or following the instructions in the message. Message and data rates may apply.

8. Data Retention

We retain personal information for only as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain business and transaction records, comply with legal, tax, accounting, and reporting obligations, resolve disputes, enforce agreements, prevent fraud, and maintain security.

Retention periods vary based on the type of information, the nature of our relationship with you, the sensitivity of the information, operational needs, legal requirements, and whether retention is necessary to protect SweetPix or others. When information is no longer reasonably necessary, we may delete it, deidentify it, or aggregate it.

9. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. These measures may include access controls, secure transmission, restricted access to customer photos, and safeguards used by our hosting, payment, and technology providers.

No website, electronic transmission, storage system, or security measure is completely secure. We therefore cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for notifying us if you believe your account or information has been compromised.

10. Your Privacy Rights and Choices

Depending on where you live and subject to applicable exceptions, you may have the right to:

  • know whether we process your personal information;
  • request access to the personal information we maintain about you;
  • request correction of inaccurate personal information;
  • request deletion of personal information;
  • receive a portable copy of certain personal information;
  • opt out of the sale or sharing of personal information or its use for targeted advertising;
  • withdraw consent where processing is based on consent; and
  • appeal our decision regarding a privacy request, where applicable.

To submit a request, email support@sweetpixapp.com with the subject line “Privacy Request” or use our website contact form. Please describe your request and provide the email address associated with your account or order.

We may need to verify your identity before completing a request. Verification may require information that allows us to match you with our records. We will use information submitted for verification only to verify and respond to the request. If we cannot verify your identity, we may be unable to fulfill the request.

You may use an authorized agent to make a request where allowed by law. We may require proof that the agent is authorized to act for you and may ask you to verify your identity directly with us.

We will not discriminate against you for exercising a privacy right. We may deny or limit a request when permitted by law, such as when information is needed to complete a transaction, detect fraud, protect security, comply with a legal obligation, or establish or defend legal claims. If applicable law provides a right to appeal, you may appeal by replying to our decision or emailing us with the subject line “Privacy Appeal.”

11. California Privacy Disclosures

California residents may have rights under the California Consumer Privacy Act, as amended, if and to the extent the law applies to SweetPix and the information at issue.

We collect these categories from you, your device, our service providers, and the other sources described in Section 1. We use and disclose them for the purposes described in Sections 2 and 5.

We do not sell personal information for money. As described in Sections 4 and 6, we use the Meta Pixel. During the preceding 12 months, we may have disclosed identifiers and internet or electronic activity to advertising and social media partners, including Meta. Those disclosures may be considered “sharing” or a “sale” under California law when used for cross-context behavioral advertising, even though SweetPix does not receive money in exchange. California residents may request to opt out by emailing support@sweetpixapp.com with the subject line “Opt-Out Request” or by using a recognized universal opt-out signal. We have not knowingly sold or shared personal information about consumers under 16 years of age.

California’s “Shine the Light” law permits certain residents to request information about disclosures of personal information to third parties for their own direct-marketing purposes. SweetPix does not disclose personal information to third parties for their own direct marketing without permission. California residents may contact us with questions using the information in Section 16.

12. Children’s Privacy

The Services are intended for a general audience and are not directed to children under 13. Children under 13 may not create an account, place an order, or submit personal information to us.

Photos uploaded by adult customers may depict children. We process those photos at the direction of the customer to provide the requested Services; that does not mean the depicted child is a user of the Services.

If you believe a child under 13 has provided personal information directly to us without appropriate parental consent, please contact us. We will take reasonable steps to investigate and delete the information where required.

Users between 13 and the age of legal majority where they live may use the Services only with the permission and supervision of a parent or legal guardian.

13. Third-Party Websites and Services

The Services may contain links to third-party websites, social media platforms, payment services, or other services that SweetPix does not control. This Privacy Policy does not apply to those third parties. We encourage you to review their privacy policies before providing them with personal information.

14. International Use and Data Transfers

SweetPix and its service providers may process and store personal information in the United States and other countries. Those countries may have privacy laws that differ from the laws where you live. Where required, we use appropriate safeguards for international transfers of personal information.

15. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our practices, Services, technology, or legal obligations. When we make changes, we will post the revised policy and update the effective date. If changes are material, we may provide additional notice as required by law.
